However, in a personal injury case, fault is the basis of the claim.

As an employee, you are entitled to benefits regardless of the nature of your injury. As long as it took place at work, you have the right to claim workers’ compensation, and there is no need to prove whose fault the incident was. However, in personal injury claims, it is important you prove the fault of another in order to have an actual case. You may recover compensation if and only if the damages are proven to be another’s fault and not, in fact, your own. Additionally, in personal injury, you may claim pain and suffering as a part of your case. This is not available in workers’ compensation.
